Same Law in Every County
There is no local variation in any of this, and it is worth saying plainly because families sometimes assume otherwise. The rule that the woman who gives birth is the legal mother applies in Longford as in Dublin. The principal surrogacy provisions of the Health (Assisted Human Reproduction) Act 2024 are uncommenced everywhere in the State. Guardianship routes under the Children and Family Relationships Act 2015 carry the same qualifying conditions in every county. And the succession consequences of a parentage gap — the one thing that cannot be repaired afterwards — are identical wherever a family lives. So the assessment of any adviser is the same across the province: can they state the commencement position precisely and with a date, do they know what can be secured while the Act remains uncommenced, do they raise wills and succession unprompted, and are they free of any relationship with agencies or clinics that might colour the advice.
Where Families Actually Are
Two groups, and they need different first steps. Those considering surrogacy want to understand the Irish consequences before committing money, choosing a jurisdiction or engaging a clinic — because the genetic arrangement, payment structure and destination all carry consequences that are difficult or impossible to unwind, and they determine whether an arrangement would fit the statutory scheme if commencement arrives mid-journey. Those whose child is already home — the larger group — usually need the opposite conversation: what can be secured now. Establishing who is a legal parent today. Wills that name the child expressly rather than relying on the phrase "my children". Guardianship for the second parent as soon as the route is available. Documentation, consents, and the evidence a future parental order application would need, including the ability to contact the surrogate. Families in this group were frequently told to wait for legislation and have waited years with the second parent holding no status at all.
